“年介49岁、家住美国纽约、并有着3个孩子的医生理查德.柏梯斯塔先生，因其将自己的肾脏捐给他妻子黛诺后不久，妻子黛诺便红杏出墙、有了外遇并欲与其离婚，柏梯斯塔先生不得不宣布：向妻子黛诺索回捐出的肾脏、或要求对方陪赏150万美元......."
用柏梯斯塔先生的话来说：“这条母狗，在我向其捐出肾脏后，居然欺骗我，所以，她必须还我肾脏！”
承办这起离婚案的相关人士这样评论道：
如果将肾脏作为商品，去和任何有价物品交换都是不合法的；
既然将肾脏作为“礼物”捐了出去，就不可以再索回；
欲要索回捐出的肾脏是不可能，或完全不可能的。。。。

Husband Wants Kidney Back From His Cheating Wife!
Dr. Richard Batista, a local doctor who donated his kidney to his wife, claims he had no idea his wife was having affair at the time he gave her the gift and now wants it back as part of the couple's divorce. He also said he would accept monetary damages instead, which experts estimate at $1.5 million.
A married couple divorced over his wife having an affair. Before their divorce he donated his kidney to save his wife's life.
The wife became sick and doctors announced she needed a kidney transplant. The Husband donates his kidney to his wife, in order to save her life. After a few weeks (during recovery) the wife allegedly cheats on her husband with her Fitness Trainer. The couple which are divorced, the husband wants her to pay a compensation for the value of a kidney.
GARDEN CITY, N.Y. When his wife needed a kidney transplant, Richard Batista gave her one of his, attorney Dominic Barbara said.
Now that Dawnell Batista has filed for a divorce, Richard Batista wants his kidney back as part of his settlement demand. Or, Barbara said Wednesday, his client wants the value of that kidney: an estimated $1.5 million.
Barbara said his client, a 49-year-old doctor from Ronkonkoma, married Dawnell Batista on Aug. 31, 1990. The couple have three children, now ages 14, 11 and 8.
After she had two failed transplants, Barbara said, his client donated a kidney to his wife in an operation that took place at the University of Minnesota Medical Center on June 18, 2001.
Batista said his marriage at the time was on the rocks because of the strain of his wife's medical issues.
“My first priority was to save her life,” Batista said at a news conference. “The second bonus was to turn the marriage around.”
Dawnell Batista, 44, of Massapequa, filed for divorce in July 2005, Barbara said.
Neither she nor her attorney could be reached for comment.
